Membership Contract – The Lambourne Golf Club 1st June to 31st May
1. Fees
Upon application, membership will not be granted until cleared funds have been received or an appropriate Direct Debit mandate has been completed. Acceptance to membership shall be at the sole discretion of The Lambourne Golf Club.
1.1 Joining Fees / Start up Fees
In addition to the subscription fee you may pay a one-off joining fee on the date of acceptance of membership. This is the rate shown in our List of Tariffs.
1.2 Affiliation fees to external golfing organisations such as the EGU/BB&O Golf Unions are included within the rates for each class of membership.
1.3 Amount
Members must pay a subscription fee for each year’s membership until the end of the subscription year on the 31st May. The Company reserves the right to vary the amount of subscription fees in its List of Tariffs at renewal. Members will be given no less than 14 days notice of any proposed increase.
1.4 There shall be no grace period for Members not paying their annual fees before the commencement of the renewal year. Cleared funds in full by that time are required for playing rights to continue.
2. Payment Terms
2.1 Initial payment comprising joining fee, bar levy, part payment, first months or annual subscription fee (where applicable), and the direct debit fee shall be due and payable on the date of acceptance of membership. Thereafter, subscription fees are payable monthly allowing the Member to spread the cost over the course of an agreed term, or annually, as elected by the Member, and payable by cash, cheque, direct debit or selected credit cards. By agreeing to a payment scheme, you are committing to paying the subscription due for the whole year’s membership.
3. Direct Debit Terms
3.1 The Company will offer Members a phased payment option for their annual fees by way of a monthly Direct Debit.
By agreeing to a Direct Debit payment scheme, you are committing to paying the subscription due for the whole year’s membership.
The annual fee will be taken over an agreed term and will be taken on the 1st or 15th of every month. If the member defaults on Direct Debit payments a £20 administration change will be applicable for the first month and £20 for any subsequent default. If you cancel your direct debit at any time, you will be liable to pay the outstanding balance due on subscriptions with immediate effect.
The Company reserves the right to take any and every option available to the Company including but not limited to small claims court and debt collection agencies in order to recover defaulted direct debit payments. If a debt collection agency is engaged by the Company, a charge of £75 will be added to the outstanding balance on the Member’s account.
Missing payments could have severe consequences including, for example, legal proceedings being taken against you and making it more difficult to obtain credit in the future. We may report non-payment to credit reference agencies, and this will adversely affect your credit rating (which most lenders consult when assessing and borrowing application).
4. Termination, Suspension, Medical Dispensation, Relocation, Transfer of Membership, Upgrading and Downgrading Membership Category
The Company reserves the right to cancel or suspend membership at any time in the following circumstances:
4.1 If a Member commits a serious or repeated breach of these Terms and Conditions or the Club Rules and the breach, if capable of remedy, is not remedied within 7 days of receipt of a default notice.
4.2 If any part of a membership fee due by a Member is not paid (by way of cleared funds) on or before its due date.
4.3 If a Member provides us with details which the Member knows to be false when applying for membership and the false declaration would have reasonably affected our decision to grant membership to that Member.
If the Company terminates the Agreement for any of the above reasons, the Company reserves the right to retain all monies that a Member has paid under his Agreement.
Medical Dispensations
Applications for medical dispensations must be made in writing to the General Manager in advance of any cessation of play.
4.4 You may apply for a medical dispensation of your membership due to serious ill health upon production of an official Doctor’s or specialist letter stating that you are unfit to play golf: If you have been a member for longer than 3 months.
The total time allowed for medical dispensation is a minimum of 1 month and a maximum of 6 months
Please note: If you are paying by Direct Debit you must NOT stop your Direct Debit payment due to medical reasons during the membership term. Membership subscriptions must continue to be paid and at renewal any approved suspension period will be deducted from the following years subscriptions. If you cancel your Direct Debit mid-term then point 3.1 above will come into effect with regards to the charges applicable to cancelling your Direct Debit and any subsequent action the club will take to recovering any outstanding debt.
Any dispensation of membership will be at the discretion of the General Manager whose decision will be final
4.5 Relocation is deemed to be a Member moving from their place of residence outside of a 50-mile radius of The Lambourne Golf Club. No refunds or release from contractual obligation will be provided to members relocating during the current year of any contract period.
4.6 Membership may be transferred at any time, providing the terminating member owes no residual subscriptions or charges to The Lambourne Golf Club. The terminating member must be present with the new member and a Lambourne Golf Club representative to complete the transaction and must return his/her membership card. An administration charge of £20 and appropriate subscriptions must be paid before the new member is issued membership. The newly issued membership shall contain this same transfer privilege. The Membership must be transferred within 45 days to be validated. Acceptance of the incoming member is at the discretion of the General Manager whose decision will be final.
4.7 It is not possible to downgrade your membership during our membership year to a category of lower value i.e. 7 day to 5 day, 5 day to Associate etc.
4.8 It may be possible during our membership year to upgrade to a another category i.e 5 day to 7 day but this will be on an invitation only basis and depends on the availability in that category.
4.9 At renewal in June, it is possible to both upgrade and downgrade subject to availability in any given category.
5. Course closures due to unforeseen circumstances
It is not company policy to compensate members for course closures outside of its control. Any review of such closures that may have occurred during the membership year will be at the company’s discretion and take place during the renewal process.
6. Health and Safety
The Company will endeavour to take due care to provide a safe environment for Members. As part of membership, Members are expected to abide by notices, signs and information provided for their safety and the safety of others.
Fire exits, which are clearly marked, are in the interest of public safety and in the event of fire and/or on hearing the fire alarm, Members and guests are asked to make their way in an orderly fashion to the nearest available exit.
7. Bar levy
7.1 For the period 1st June to the 31st May the Club will require Members (excluding juniors) to pay a bar levy. This levy must be spent on products purchased at the Bar or on Catering by the 31st May each year.
On renewal if the original bar levy has not been used then this will not be carried over to the new subscription year. Any tops up during the membership year over and above the original bar levy will be carried over into the new subscription year.
7.2 If a Member ceases to renew his/her membership any un-used bar levy on the members card becomes property of The Lambourne Golf Club.
8. Associate Membership
There is no direct debit option for Associate membership in the 1st year of membership
Clauses 4.4, 4.5 and 4.6 of this contract are not applicable to Associate Membership
If you use your allocation of points before the end of the subscription year, you may upgrade to another membership category by payment of the relevant subscription on a pro-rata basis or top up by 300 points, which costs £300.
You may not exceed your allocated points during the membership term. Your membership will go into suspension and it will not be possible to play until any debit of credit is rectified.
9. Principal contract
This Membership document and the Company’s Rules form the principal contract between you and The Lambourne Golf Club. By ticking YES below you - the Member - agree to comply with the Terms & Conditions of membership set out in this document and the Club’s Rules
This contract is subject to change without prior notice and is at the discretion of the General Manager.
By becoming a member of The Lambourne Club and submitting payment for membership subscriptions, you hereby acknowledge and agree to be bound by the terms and conditions set forth in this contract.
